Please read these Terms and Conditions carefully. By opening an account, purchasing a pass or membership, attending classes or events (online or in-studio), or using our website, you agree to be bound by these Terms and Conditions.
IMPORTANT NOTICE – AUSTRALIAN CONSUMER LAW
Nothing in these Terms and Conditions excludes, restricts or modifies any rights or remedies you may have under the Australian Consumer Law or any other applicable legislation which cannot lawfully be excluded.
Where a service is supplied in trade or commerce to a consumer, statutory consumer guarantees apply. If a service fails to meet a consumer guarantee, you may be entitled to a remedy in accordance with the Australian Consumer Law.
CLASSES, COURSES, WORKSHOPS & EVENTS
- Live and Breathe Yoga reserves the right to refuse entry or remove any participant whose behaviour is disruptive, unsafe or inappropriate.
- Schedules, teachers, pricing and class formats are subject to change. Where possible, reasonable notice will be provided.
- Refunds will not be provided for change of mind, missed classes, or failure to attend. However, if Live and Breathe Yoga cancels a class, workshop, course or event and does not reschedule it within a reasonable time, you will be entitled to a credit or refund.
- If an event is interrupted or discontinued due to circumstances beyond our control after more than 50 percent has been delivered, no refund will be provided unless required under Australian Consumer Law.
- All bookings are non-transferable unless otherwise agreed in writing.
- An 8-hour cancellation policy applies to all classes unless otherwise stated. Late cancellations or no-shows may result in forfeiture of the session.
MEMBERSHIP STRUCTURE AND MINIMUM TERMS
Live and Breathe Yoga offers the following memberships:
- All In Membership
Minimum term: 12 months
Freeze allowance: Up to 4 weeks per calendar year. Freeze periods extend the minimum term accordingly. - Momentum Membership
Minimum term: 4 months
Freeze allowance: Up to 2 weeks per membership period. Freeze periods extend the minimum term accordingly. - Starter Membership
Minimum term: 4 months
Freeze allowance: Up to 2 weeks per membership period. Freeze periods extend the minimum term accordingly. - Freedom Membership
Minimum term: 1 month
No standard freeze allowance unless agreed in writing. - Virtual Membership
Minimum term: 4 months
Freeze allowance: Up to 2 weeks per membership period. Freeze periods extend the minimum term accordingly.
- All cancellations must be submitted via the official Live and Breathe Yoga Membership Cancellation Form.
- Two weeks’ written notice is required once the minimum term has been completed.
- If cancellation is requested prior to completion of the minimum term, the remaining balance of the contracted period becomes immediately payable.
- Studio access will be suspended where payments cease prior to completion of the minimum term. Access may be reinstated once the outstanding contractual balance has been paid in full.
- Cancellation of a direct debit authority with a bank or financial institution does not cancel a membership agreement.
- Nothing in this section excludes rights under Australian Consumer Law.

GRIEVANCE POLICY
The Live and Breathe Yoga Studio Complaints Handling Policy ensures that users, suppliers or third parties have the right to the principles of fairness, accessibility, transparency, responsiveness, accountability and constructiveness.
We welcome feedback, both positive and negative, from users or suppliers. This allows us to correct any problems with our service, to learn how to improve our service quality and to maintain positive relationships with our clients, students and teachers.
Live and Breathe Yoga Studio is committed to a fair and just system for responding to complaints and grievances. This policy ensures complaints are dealt with sensitively, confidentially, effectively and promptly.
RETURNS AND REFUND POLICY
Live and Breathe Yoga is not liable to refund, transfer or offer compensation of any kind for classes, workshops, programs or training courses that are late, changed or cancelled for any reason. No refunds will be issued unless Live and Breathe Yoga cancels a class, workshop, course or event. If the class, workshop, course or event has to be interrupted or abandoned, no money will be refunded if more than half of it has taken place. Some exceptions may be allowed solely at the discretion of Live and Breathe Yoga.
- Currently we abide by a strict 8hr cancellation policy. If you do need to cancel, please cancel 8 hours before class.
- For class passes or casual pass holders, you will forfeit the class if cancelled less than 8 hours before class or are a no-show or if the pass has expired.
- Single classes and class passes are non-refundable and have expiry dates and will not be extended. Refunds will not be issued on unused passes.
- Class passes and memberships exclude attendance at guest teachers’ classes and workshops or specialty classes.
- Class passes are non- transferable and cannot be suspended.
- Memberships are non-sharable or transferable and refunds will not be issued for unused memberships.
- Live and Breathe Yoga does offer a credit on merchandise if it is faulty. It must be returned within 7 days with a valid receipt of purchase. Items must not have been used. We retain the right to refuse return/credit.
