TERMS AND CONDITIONS
Please read these Terms & Conditions carefully. If you do not agree to these Terms & Conditions do not open an account with Live and Breathe Yoga, attend a session, workshop, immersion, intensive, retreat or any other activity either online or in-studio or otherwise use or purchase from the website.
CLASSES, COURSES, WORKSHOPS & EVENTS
To comply with fire regulations and our Covid Safe plan, everyone is required to check-in and pay before each class attended. If you are a new client please be prepared to complete a student registration form with your booking online.
Live and Breathe Yoga reserves the right to refuse admission to the studio.
Latecomers may be admitted at the discretion of management and teacher/workshop leader.
Bookings are made subject to Live and Breathe Yoga’s right to alter the schedule or teaching staff as a result of circumstances beyond its control.
No refunds will be issued unless Live and Breathe Yoga cancels a class, workshop, course or event. If the class, workshop, course or event has to be interrupted or abandoned, no money will be refunded if more than half of it has taken place. Some exceptions may be allowed solely at the discretion of Live and Breathe Yoga.
All Bookings and payments are non-refundable, non-transferable, and no extensions will be given
STUDIO MEMBERSHIPS
When you purchase a Studio Membership (fortnightly payment subscription) you are agreeing to this policy:
- Studio Memberships are for a minimum of 12 months. (EARLY CANCELLATIONS WILL NOT BE GRANTED)
- No joining or set up fee.
- Packages cannot be refunded, transferred, or cancelled unless you are moving away or have a serious injury/illness (with doctors’ certificate).
- Unused classes cannot be carried over to the next fortnight or month.
- We require 4 weeks’ notice to cancel in writing via email. You can pay out the balance in full if you wish to cancel before the 12 months minimum period ends.
- You can freeze your unlimited membership for up to 4 weeks every year. The amount of time you freeze the membership will be added onto your 12-month minimum commitment period.
VIRTUAL MEMBERSHIP
When you purchase a Virtual Membership (fortnightly payment subscription) you are agreeing to this policy:
- Unlimited Memberships are for a minimum of one term (12 weeks) EARLY CANCELLATIONS WILL NOT BE GRANTED.
- No joining or set up fee.
- Packages cannot be refunded, transferred, or cancelled unless you are moving away or have a serious injury/illness (with doctors’ certificate).
- Unused classes cannot be carried over to the next fortnight or month.
- We require 4 weeks’ notice to cancel in writing via email.
TERM PASSES, MONTHLY PASSES AND INTRO PASSES
When you purchase any of the above pass you are agreeing to this policy:
- There will be no extensions on the pass
- No joining or set up fee.
- Packages cannot be refunded, transferred, or cancelled
- Unused classes cannot be carried over to the next term
GIFT VOUCHERS
Gift vouchers are valid for 3 years from date of purchase. Gift vouchers are non-refundable and cannot be extended for use after the date of expiry.
HEALTH
If you are pregnant, suffer from very high blood pressure, chronic heart disease, retinal problems, epilepsy, have a joint replacement or recently undergone any major surgery please consult your doctor prior to booking classes.
You must inform the teacher at the start of the class if you are suffering from any injuries, medical conditions or are taking any medication that may affect your yoga practice. You must ensure you do not do anything that will cause harm or injury to yourself or others in the studio.
CHANGES TO OUR TERMS AND CONDITIONS
We reserve the right to change our terms and conditions at any time and should this occur, the amendment will be posted here on our website.
POLICIES
Please read these Policies carefully. If you do not agree to these Policies do not open an account with Live and Breathe Yoga or otherwise use the website. By browsing through and using this website you are agreeing to comply with and be bound by the following policies, which together with the Terms and Conditions, govern Live and Breathe Yoga’s relationship with you in relation to this website. The term ‘you’ refers to the user or viewer of this website. If you disagree with any part of these terms and conditions, please do not view or purchase from this website, attend in studio or virtual sessions.
SECURITY POLICY
While we take every reasonable precaution to ensure your belongings are safe however Live and Breathe Yoga will not be held responsible for your personal belongings while on the premises. Your personal and payment information security is highly important to us at Live and Breathe Yoga. We take website and credit card security extremely seriously and have in place security measures that provide the highest level of protection available. All credit card details are encrypted and never made visible. We do not store your credit card details.

All personal information collected from our website is used only for our internal marketing and for us to provide our services to you. We do not share or sell any information with outside parties.
Live and Breathe Yoga makes use of third party software, Momence, to manage bookings and Flodesk for e-newsletters. We also use a number of social media platforms.
We respect your Privacy and we endeavour to keep your personal information completely confidential.
We would only release personal information if we were required to by law to facilitate court proceedings; enforce or apply our terms and conditions; or protect the rights, property, or safety of Live and Breathe Yoga, our users, or others.
We collect personal information for the purposes of delivering our products and services and communicating with customers regarding our services through our website. We collect personal information:
• from users – when they register an enquiry, book a class through the online booking form or make a purchase
• from suppliers or third parties – when they are engaged to supply services to us, provide information to us or invoice us for the provision of services;
• when we receive enquiries through the Website and when the Website is otherwise accessed or used.
The kind of personal information we may collect will depend on who you are (e.g. a customer or supplier) and the nature of your interaction with us, and may include your full name, email address, company name, billing information and other personal information.
If you do not provide us with all the information we request, we may not be able to deliver our services.
Live and Breathe Yoga will seek to take all reasonable steps to keep any information we hold about you secure, accurate and up to date. Your information is stored on secure servers and Live and Breathe Yoga will take all reasonable steps to ensure that our employees and contractors respect the confidentiality of any personal information held by us. You should notify us immediately if there is any unauthorised use of your account or any other breach of security. However, Live and Breathe Yoga does not accept responsibility for any consequences of the unauthorised access to your information.
As with most websites, we collect information on web site activity such as the number of users who visit the site, the date and time of visits, the number of pages viewed, from which country and web browser the site has been accessed and the address of any web sites from which this site has been accessed. This information alone does not identify an individual. It simply provides us with statistics that we can use to analyse and improve your experience on our web site.
We may amend this Privacy Policy from time to time. The current version will be published on our website.
GRIEVANCE POLICY
The Live and Breathe Yoga Studio Complaints Handling Policy ensures that users, suppliers or third parties have the right to the principles of fairness, accessibility, transparency, responsiveness, accountability and constructiveness.
We welcome feedback, both positive and negative, from users or suppliers. This allows us to correct any problems with our service, to learn how to improve our service quality and to maintain positive relationships with our clients, students and teachers.
Live and Breathe Yoga Studio is committed to a fair and just system for responding to complaints and grievances. This policy ensures complaints are dealt with sensitively, confidentially, effectively and promptly.
RETURNS AND REFUND POLICY
Live and Breathe Yoga is not liable to refund, transfer or offer compensation of any kind for classes, workshops, programs or training courses that are late, changed or cancelled for any reason. No refunds will be issued unless Live and Breathe Yoga cancels a class, workshop, course or event. If the class, workshop, course or event has to be interrupted or abandoned, no money will be refunded if more than half of it has taken place. Some exceptions may be allowed solely at the discretion of Live and Breathe Yoga.
- Currently we abide by a strict 8hr cancellation policy. If you do need to cancel, please cancel 8 hours before class.
- For class passes or casual pass holders, you will forfeit the class if cancelled less than 8 hours before class or are a no-show or if the pass has expired.
- Single classes and class passes are non-refundable and have expiry dates and will not be extended. Refunds will not be issued on unused passes.
- Class passes and memberships exclude attendance at guest teachers’ classes and workshops or specialty classes.
- Class passes are non- transferable and cannot be suspended.
- Memberships are non-sharable or transferable and refunds will not be issued for unused memberships.
- Live and Breathe Yoga does offer a credit on merchandise if it is faulty. It must be returned within 7 days with a valid receipt of purchase. Items must not have been used. We retain the right to refuse return/credit.
YOGA TEACHER TRAINING (YTT) POLICES
Despite the careful application process to ensure students are suitable for the course, policies are in place for occasions where it may be necessary for a student to withdraw, or where a payment agreement is not fulfilled. Once a suitable applicant has been offered a place into the course, they will be required to pay:
- A non-refundable deposit
- A program fee which may be at an early bird price if made by the date detailed in the prospectus.
If a student fails to pay the program fee in full or set up the payment plan within 14 days of offer of a place, we have the right to cancel the offer of a place in the course.
If a student fails to pay the program fee, via upfront payment or direct debit agreement, 21 days prior to course commencement, we have the right to cancel the offer of a place in the course.
If a student withdraws from the course more than 21 days prior to course commencement, they will receive a refund of all course fees paid, minus the deposit.
If a student withdraws from the course within 21 days of course commencement, they will not be eligible for any refunds.
Once you sign up for a YTT, there is a level of commitment. Our commitment to you is to complete your certificate of training.
You may defer your training to another suitable time, year, if that is appropriate and there is a place in the next course, if you should become unwell which would mean you can’t attend. A medical certificate is required and is at the discretion and decision by the Live and Breathe Yoga management.
In the event of a pandemic, or world crisis you will be offered to complete online. Every reasonable effort will be made to assist you to complete your certificate. The course will run in the same way however face to face trainings will be live and online.
You must complete and participate in all the modules to complete your YTT certificate.
Expulsion policy
Teacher trainees are subject to the all Live and Breathe Yoga Polcies and Terms and Conditions and are expected to observe the values and practices of Live and Breathe Yoga. A Trainee may be removed from the course where they are unable to comply with the Terms and Conditions or align to the publicised values and practices. Prior to expulsion the trainee will be provided with verbal or written notice, informing them of the basis for the potential expulsion and provided with an opportunity to respond in writing or verbally. After review of the evidence, Live and Breathe Yoga will issue a decision whether to expel the trainee from the course, based on its reasonable judgment of the evidence presented to them.
Live and Breathe Yoga is not liable for any losses or damages a trainee may incur due to being removed from the course. Any decision resulting in expulsion or premature withdrawal from the course will result in the loss of all fees paid, and no reimbursement will be provided.
COVID-19 POLICY
A Covid-19 Policy will be in place as required, in accordance with government health advice, and local, state, and federal legislation at the time of course commencement and throughout the course delivery.
